(KNSI) – A local elected official accused of sexually assaulting an underage girl is retiring.

Benton County Attorney Philip Miller’s last day will be January 3rd when his replacement is sworn-in following November’s election. Assistant County Attorney Karl Schmidt is running unopposed for the seat.

The Benton County Board’s approval allows Miller to submit paperwork to the Minnesota Public Employees Retirement Association. In July 2021, Miller was charged with two counts of second-degree criminal sexual conduct and one count of third-degree criminal sexual conduct. He is accused of sexually assaulting a 15-year-old girl in 2020.

Miller has pleaded not guilty and adamantly denies the charges. The case is still working its way through the courts.
