(KNSI) — A federal judge in Florida has struck down the mask mandate for airplanes and other public transportation.
The mandate was set to expire on April 18th but was extended through May 3rd after concerns about the new Omicron subvariant arose. U.S. District Judge Kathryn Kimball Mizelle said the Centers for Disease Control overstepped its authority, calling the rule invalid.
Court papers said the mandate was “arbitrary and capricious” and accused the CDC of not explaining itself. The judge agreed saying it needed to explain why it acted as it did.”
The CDC has not said if they will appeal the judge’s decision.
