(KNSI) — A Swanville man has been arrested after police say he was driving under the influence and ran from a traffic stop early Monday morning.

According to a criminal complaint, about 2:30 a.m., a Stearns County deputy sheriff was on County Road 75 in St. Joseph when he noticed a car driving with only one headlight. The officer pulled him over, and as he was getting out of his squad car, he says the driver, 42-year-old Michael Shawn Day, drove away.

An officer with the St. Joseph Police Department says he saw Day’s car a short time later near County Road 75 and County Road 134. The criminal complaint says he tried to pull Day over, but he again sped away, turning into a nearby gravel pit entrance.

Police found Day, who stopped and was taken out of his car at gunpoint.

Court papers say Day was showing signs of impairment, and when an officer asked Day how much he had to drink, he said, “too much.” Officers performed field sobriety tests on Day, who was arrested and showed a blood alcohol concentration of .18.

The criminal complaint says Day also was stopped for driving under the influence and driving after revocation in Todd County in June.

Day was charged in Stearns County District Court for DWI, DWI with a blood alcohol concentration of .08 within two hours, and fleeing police.
