(KNSI) – The man who authorities say drove into a crowd of protesters in Uptown Minneapolis Sunday night, killing one, has been charged in Hennepin County District Court.

Thirty-five-year-old Nicholas Kraus of St. Paul is charged with second-degree intentional murder and two counts of assault with a dangerous weapon.

Demonstrators were gathered at the intersection of Lake Street and Girard Avenue in Minneapolis Sunday evening to remember Winston Boogie Smith Jr., who was fatally shot earlier this month by members of a U.S. Marshals Service task force that sought to arrest him. Kraus allegedly drove an SUV toward the crowd, hitting a parked car that then hit several people. The impact injured three people and killed 31-year-old Deona Knajdek.

Kraus is now in jail awaiting his first court appearance on Friday. His bail is set at $1 million.

Police say drugs or alcohol may have been involved. The Associated Press reports that Kraus has five prior DWI convictions and that his driver’s license was canceled in 2013.
