30 percent rental rule in Winona challenged

WINONA, Minn. (AP) - Four homeowners are suing the city of Winona over a rule that restricts the number of rental properties to 30 percent of a city block.

The plaintiffs say the city's rule is unconstitutional and illegal because it prevents homeowners from renting their properties. One of the plaintiffs, Ted Dzierzbicki says he and his wife put their home up for sale in January 2010, but have been unable to sell it.

The couple wanted to rent the property, but can't get a rental license because the block is at capacity. The other plaintiffs face similar situations.

Winona City Attorney Chris Hood tells the Daily News that two of the plaintiffs were granted exceptions to the rule earlier this year and can rent their properties through April 2012.
