(KNSI) - A man accused of dropping his young niece from a 3rd story balcony in St. Cloud has been found incompetent to stand trial.
Baraka Mohamed Ahmed has been found mentally ill and unable to understand the charges against him or be able to help out in his own defense.
According to the criminal complaint, the state is in the process of having the 33-year-old civilly committed until he can stand trial.
Prosecutors say they plan to have the St. Cloud man stand trial once his competency is restored.
The St. Cloud Police Department says the incident happened around 4:40 p.m. on March 18th, at an apartment building in the 1900 block of Quarry Road.
According to the criminal complaint, a witness says they saw Ahmed holding the girl by the wrists, and then he let go, and the girl fell to the parking lot below.
Police say the 4-year-old suffered a broken leg when she hit the pavement.
Police officers caught up with Ahmed later in the night and arrested him.
At the time of his arrest, police said Ahmed is non-verbal and has developmental issues.
Ahmed was charged with 3rd degree assault.
