(KNSI) - A St. Cloud man acquitted of attempted murder has admitted to assaulting a woman who was called as a witness for the prosecution in his trial.
55-year-old Herbert Owen Campbell pleaded guilty to a misdemeanor charge of domestic assault just before his trial was about to start.
He was sentenced to 90 days in jail and two years probation.
Campbell must serve 12 days in jail and will have the other 78 days stayed, meaning he won't serve them unless he violates the terms of his two-year probation.
As part of the plea deal a felony charge of 3rd degree assault and domestic assault were dismissed.
Police were called to an apartment at 816 9th Avenue Southeast in St. Cloud on October 6th for a domestic assault in progress between Campbell and a 36-year-old woman.
The two share the apartment.
According to the criminal complaint, Campbell struck the woman in the face, threw her into a wall and pushed her into a door as he kicked her out of the apartment.
The victim was taken to St. Cloud Hospital where she was treated for a ruptured ear drum.
In June, a jury found Campbell not guilty in the March 2017 shooting of 36-year-old Enrique Lopez in a driveway on Waite Avenue North in Waite Park.
Lopez was taken to St. Cloud Hospital in critical condition.
Campbell claimed self-defense.
